E-script Requirements Going Into Effect

Effective March 27, 2016, a new law will require New York State prescribers to issue prescriptions electronically directly to a pharmacy, with limited exceptions. The new law requires electronic prescribing for all types of medications (controlled substances and non-controlled substances) and for syringes and other medical devices dispensed at a pharmacy in New York.

The uncertainty surrounding the new law and its implementation by the NYS Department of Health remains a source of concern for pharmacies. An additional concern is how PBMs and other third party payors will interpret the new law when auditing pharmacies. If you have questions pertaining to planning for compliance with the new law, feel free to contact your healthcare legal team by phone at 212.668.0200 or via email at info@mdrxlaw.com.
