New Jersey Act Imposes New Requirements to Protect Consumers

New Jersey providers should be alert to the recently signed into law Out-of-Network Consumer Protection, Transparency, Cost Containment, and Accountability Act.The Act pertains to, and enhances, consumer protections related to out-of-network healthcare charges.Health care facilities and professionals must ensure their compliance with these new requirements to avoid statutory penalties.

Specifically, providers should ascertain compliance with the standards set by the Act for out-of-network health care facilities and professionals, specifically out-of-network entities.To abide by the Act, health care practitioners must provide information to patients regarding their network status, explaining health benefit plans, and estimating bills of service and other anticipated costs of services.The goal of the Act is to enhance transparency in pricing for health care services.Additionally, the Act restricts providers' abilities to bill patients in certain circumstances and creates a dispute resolution process.

Violation of any provision of the new Act could amount up to a $25,000 penalty or an investigation by the relevant professional or licensing board.
